When you visit our website https://www.gammaconstruction.mu/ (the “Website”) and our premises, we appreciate that you are trusting us with your personal information. We take your privacy very seriously. In this privacy notice, we seek to explain to you in the clearest way possible what information we collect, how we use it and what rights you have in relation to it.

This privacy notice applies to all information collected through our Website and to all visitors visiting our premises.

1.  What personal data do we collect and for what purpose(s)?

1.1.         Information from users of the Website

We collect personal information that you voluntarily provide us when you express an interest in obtaining information about us and our services or otherwise when applying for a job or when you contact us.

The personal data we collect include surname, name, phone number, address, email address and curriculum vitae.

1.2.         Information from visitors visiting our premises

At Gamma Construction Ltd, we are taking necessary actions to prevent the spread of the COVID-19. We request that you, as a visitor to our site, join in our efforts to keep everyone – both visitors and employees – safe and healthy.

If a visit is necessary, please make sure a prior appointment with your contact at Gamma Construction Ltd is made for your intention to come to the office.

A screening will be done and the following data will be recorded temperature, name, phone numbers, the company you are from. You will also be required to fill in a declaration form where you will have to provide the following personal data:

  • Health status (e.g. any signs of flu),
  • Travel history in last 14 days,
  • If you were in contact with a person showing signs of COVID-19, you will have to provide: name of the person, your relationship with the person, location and treatment done,
  • If you were in contact with a person who has travelled abroad or who was in quarantine. You will have to provide: name of the person, country travelled, duration of stay, date of arrival to MRU.

2. What are the lawful bases we rely upon to process your personal data?

  • Consent: We will process your data if you have given specific consent. Where information is provided voluntarily, it will be considered as consent.
  • Legal Obligation: We will process your data to comply with the legal obligation to which we are subject.
  • Legitimate Interests: We will also process your data when it is reasonably necessary to achieve our legitimate business interests.

3. How long do we keep your personal data?

We will only keep personal information for as long as it is necessary to fulfil the purpose outlined in this privacy notice which will be a maximum of 3 years unless a longer retention period is required or permitted by law (such as the Companies Act or other legal requirements).

When we have no ongoing legitimate business need to process your data, we will delete them.

4. How do we keep your personal data safe?

We have implemented appropriate technical and organisational measures to protect the security of any personal data.

However, note that despite our efforts to secure information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot guarantee that cybercriminals will not be able to defeat our security. While we will do our best to protect your data, the transmission of personal information to and from our Website is at your own risk. You should therefore only access the Website within a secure environment.

5.  Do we collect information from children?

By using the Website, you present that you are at least 16 years. If we learn that the personal information is from users less than 16 years, we will delete the data immediately.

6. Will your personal data be shared with anyone?

We only share information with your consent, to comply with laws, to provide you with services, to protect your rights or to fulfil business obligations.

For website users, we may share your data in the following situation:

We may share your information with our affiliates, in which case we will require those affiliates to honour this privacy notice. Affiliates include our parent company and any subsidiaries, joint venture partners or other companies that we control or that are under common control with us.

For visitors to our premises, we may share your personal data with the Ministry of Health and Wellness if required.

7.  Do we transfer your personal data outside Mauritius?

Information collected through our website is stored on a server outside Mauritius. To the fullest extent allowed by applicable law, by using the above, you voluntarily consent to the storage of the data on our website outside Mauritius.

8. Does the Website use Cookies?

We do not use cookies on this website.

9. Does the Website contain links to other Websites?

Our Website may contain links to another website that are not operated by us.  If you click on the third-party link, you will be redirected to that third-party’s Website. So, we strongly advise you to review the Privacy Policy/Notice of every Website you visit.

Please be aware that we have no control over the content and practices of these sites and cannot accept responsibility or liability for their respective privacy policies.

10.  What are your rights?

We are committed to helping you to meet your rights under the Data Protection Act 2017. You have the right to request access to your personal data we process about you and have a copy free of charge, to change or delete the data in certain circumstances.  You also have the right to refuse or object to the processing of your data, with the understanding that we may be unable to provide you with some of your desired services.

Your request will be responded to within one month. However, this period may be extended by a further month if your request is too complex or if we have received many requests from other data subjects.
